Terms and Conditions

Please read these Terms and Conditions carefully before enrolling in or purchasing any KOKO Matrix program or service. By accessing our website or purchasing a program, you agree to be bound by these terms.

1. About Us

KOKO Matrix is a business coaching and leadership program operated by Kate Osborne, based in Queensland, Australia.

2. Programs and Services

KOKO Matrix offers the following programs and services:

  • KOKO Matrix Mastery Workshop — a 10-week live business coaching program
  • First Fridays Club — a monthly online community and coaching program
  • Other workshops, events, and coaching services as announced from time to time

All programs are subject to availability. KOKO Matrix reserves the right to modify, cancel, or reschedule programs at any time.

3. Enrolment and Applications

Enrolment in KOKO Matrix programs is subject to an application process. Submission of an application does not guarantee a place in the program.

Kate Osborne personally reviews all applications and reserves the right to decline any application at her sole discretion. If your application is unsuccessful, any payment made will be refunded in full.

Once your application is accepted and payment is received, your place in the program is confirmed.

4. Fees and Payment

Program fees are as listed on our website at the time of enrolment. All prices are in Australian Dollars (AUD) and include GST where applicable.

Payment options:

  • One-off payment: full program fee paid upfront
  • Payment plan: available for selected programs — terms and instalment amounts are specified at the time of enrolment

Payments are processed securely via FastPayDirect. By making a payment, you agree to FastPayDirect’s terms and conditions.

In the event of a failed payment on a payment plan, KOKO Matrix reserves the right to suspend your access to the program until payment is received.

5. Refund and Cancellation Policy

KOKO Matrix Mastery Workshop:

  • If you attend the first three sessions and are not satisfied, you may request a full refund within 24 hours of completing session three
  • Refund requests must be submitted in writing to hello@kokomatrix.com
  • No refunds will be issued after session three or if you have not attended the first three sessions
  • If KOKO Matrix cancels or reschedules the program, you will be offered a transfer to the next available cohort or a full refund

All other programs and services:

  • Cancellations made more than 14 days before the program start date will receive a full refund
  • Cancellations made 7 to 14 days before the start date will receive a 50% refund
  • Cancellations made less than 7 days before the start date are non-refundable
  • Transfers to a future cohort may be available at KOKO Matrix’s discretion

6. Program Delivery

The KOKO Matrix Mastery Workshop is delivered as live sessions on the Gold Coast, Queensland, Australia. Session details including dates, times, and location will be confirmed upon enrolment.

Sessions are recorded for participants who are unable to attend. Recordings are provided for personal use only and must not be shared or distributed.

KOKO Matrix reserves the right to substitute facilitators or adjust program content where necessary. Material changes will be communicated to participants in advance.

7. Participant Responsibilities

As a participant, you agree to:

  • Attend sessions punctually and engage constructively with the program
  • Complete any pre-work, exercises, or tasks assigned between sessions
  • Treat other participants, facilitators, and staff with respect
  • Maintain the confidentiality of other participants’ information shared during the program
  • Not record, reproduce, or distribute any program content without prior written consent

KOKO Matrix reserves the right to remove any participant from the program without refund if their behaviour is disruptive, disrespectful, or in breach of these terms.

8. Intellectual Property

All content, materials, frameworks, methodologies, tools, and resources provided as part of KOKO Matrix programs are the intellectual property of Kate Osborne / KOKO Matrix.

Participants are granted a limited, non-exclusive, non-transferable licence to use program materials for their own personal business purposes only. You may not:

  • Copy, reproduce, or distribute program materials to third parties
  • Use program materials to develop competing products or services
  • Remove or alter any copyright, trademark, or proprietary notices

The KOKO Matrix name, logo, and methodology are protected intellectual property. Unauthorised use is prohibited.

9. Confidentiality

During the program, participants may share sensitive business and personal information. All participants agree to:

  • Maintain strict confidentiality of information shared by other participants
  • Not disclose, share, or use information about other participants outside the program
  • Respect the trust placed in the group by all members of the cohort

KOKO Matrix will also maintain confidentiality of participant information in accordance with our Privacy Policy.

10. Results Disclaimer

KOKO Matrix programs are designed to provide business education, coaching, and strategic frameworks. Results will vary depending on individual circumstances, effort, and implementation.

Testimonials and case studies shared on our website represent the experiences of specific participants and are not a guarantee of results. KOKO Matrix makes no warranties or representations regarding specific outcomes from participation in our programs.

You acknowledge that business success depends on many factors outside of KOKO Matrix’s control, and that participation in our programs does not guarantee any particular financial or business outcome.

11. Limitation of Liability

To the maximum extent permitted by Australian law, KOKO Matrix and Kate Osborne will not be liable for:

  • Any indirect, incidental, special, or consequential loss or damage
  • Loss of profit, revenue, business opportunity, or data
  • Any loss or damage arising from your reliance on program content or advice

Our total liability to you for any claim arising out of or in connection with our programs or services will not exceed the amount you paid for the relevant program.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Consumer Rights

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL), including consumer guarantees that cannot be excluded by law.

If you are a consumer under the ACL, you may have rights to remedies including repair, replacement, or refund for major failures and compensation for other reasonably foreseeable loss or damage.

13. Privacy

Your use of our programs and services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. Our Privacy Policy is available at www.kokomatrix.com/privacy-policy.

14. Website Use

Your use of our website (kokomatrix.com) is subject to the following conditions:

  • You must not use our website for any unlawful purpose or in any way that could damage, disable, or impair our website
  • You must not attempt to gain unauthorised access to any part of our website or systems
  • We reserve the right to restrict or terminate your access to our website at any time

Our website may contain links to third-party websites. We are not responsible for the content or practices of those websites.

15. Changes to These Terms

KOKO Matrix reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with an updated date. Your continued use of our services after changes are posted constitutes your acceptance of the updated terms.

We recommend you review these terms periodically.

16. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Queensland.

17. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at hello@kokomatrix.com to seek a resolution. We will endeavour to resolve any dispute promptly and fairly.

If a resolution cannot be reached, either party may seek mediation through a recognised dispute resolution service before commencing legal proceedings.
